Common use of Preadvice of Payment Clause in Contracts

Preadvice of Payment. The Issuer, failing whom the Guarantor, shall procure that the bank through which the payment to the Issuing and Principal Paying Agent required by Clause 4.14.1 is to be made shall irrevocably confirm to the Issuing and Principal Paying Agent by facsimile or authenticated SWIFT message no later than 3.00 p.m. (local time in the city of the Issuing and Principal Paying Agent’s specified office) on the second Business Day before the due date for any such payment that it will make such payment. In this Clause, the date on which a payment in respect of the Notes becomes due means the first date on which the holder of a Note, Receipt or Coupon could claim the relevant payment by transfer to an account under the Conditions, but disregarding the necessity for it to be a Business Day in any particular place of presentation.
