Common use of Preconditions Clause in Contracts

Preconditions. As preconditions to the effectiveness of any of the modifications, consents, or waivers contained herein, the Borrower agrees to provide the Agent with the following: (1) This Agreement and the Guarantor’s Ratification, properly executed, (2) a waiver fee in the amount of $15,000, and (3) Lender’s counsel’s fees.

Preconditions. As preconditions a precondition to the effectiveness of any of the modifications, consents, or waivers contained herein, the Borrower agrees to to: (A) provide the Agent with the following: (1) This Agreement and the Guarantor’s Ratificationthis Agreement, properly executed, ; (2B) a waiver pay to the Agent an amendment fee in the amount of $15,000; and (C) pay, promptly upon presentation of an invoice therefor, all other fees and (3) Lender’s counsel’s feescosts incurred by the Lenders in entering into this Agreement, including, but not limited to, all reasonable legal fees incurred by the Agent.
