Preferred subcontractors. The Employer may list which subcontractors or suppliers the Contractor is required to enter into subcontracts with. If the Contractor subcontracts work, he is responsible for providing the Service as if he had not subcontracted. This contract applies as if a Subcontractor’s employees and equipment were the Contractor’s.

Preferred subcontractors. The contractor has committed in subcontracting thirty percent of the work to designated companies that have already been submitted to Eskom during the tender stage. Progress on money spent on subcontractor/s shall be submitted to Eskom on a quarterly basis as part of the SD&L progress report. Failure to meet the subcontracting requirements as agreed during negotiations and part of tender requirements shall result in the tender being cancelled.
Preferred subcontractors. Preference is given to South African companies as possible subcontractors. Local resources should be utilised where possible. A predetermined and mutually agreed value of this contract, at the Contract Date, is attributable to Eskom Holdings SOC Ltd classified Black Economic Enterprises (BEE) / Small Medium & Micro Enterprises (SMME) or Black Woman Owned (BWO) Enterprises. The value attributed to such enterprises is monitored by the Contractor and submitted to the Project Manager by means of a 3-monthly statement of expenditure.
Preferred subcontractors. The Contractor will be required to provide the Employer with all information regarding his Subcontractors. The Employer will need to approve all Subcontractors to be used by the Contractor. The Contractor shall be responsible for all the activities performed by the Subcontractors.

Where the Contractor employs a Subcontractor operating in the Working Areas, then the Contractor ensures that the Subcontractor complies with the EMP, SES and PES as appropriate and that the Subcontract documentation places back-to-back obligations on the Subcontractor which reflect the Contractor’s obligations under the EMP, SES and PES, all within the Contractor’s Quality Management System. The Contractor uses an NEC3 Engineering and Construction Subcontract with Main Option A when he subcontracts portions of the Works which amount to more than 25% of the contract value. Where the Contractor is required to remove an animal, reptile or bird from the Working Areas, the Contractor engages a Subcontractor who is a specialist and qualified for such removal (including the removal of rare, endemic or endangered species).
Preferred subcontractors. In certain sites there are specialist equipment and services that are required, and Eskom reserves the right to choose the subcontractor that is required to execute such function. Eskom also reserves the right to choose subcontractors based on quality and price.
