Preliminary Plat. Unless already provided to Buyer under Section 5.1 of this Agreement, prior to submittal to the applicable Governmental Authorities, Seller shall deliver to Buyer, for Buyer’s review, comment, and approval, Seller’s proposed preliminary plat (the “Preliminary Plat”) for each Section of Lots, which Preliminary Plat shall be consistent with the Site Plan except for such changes as are required by Governmental Authorities (subject to the terms of this Section 9) or have been approved by Buyer in writing.

Preliminary Plat. Attached as Schedule D to this Agreement is an approved preliminary plat (the “Preliminary Plat”) showing the Townhome Lot. A final subdivision plat (the “Final Subdivision Plat”) showing the Townhome Lot has not yet been properly approved under the subdivision ordinance or recorded with the Register of Deeds of the county in which the Townhome Lot is located. A FINAL SUBDIVISION PLAT HAS NOT BEEN APPROVED OR RECORDED ON THE DATE OF THE AGREEMENT. NO GOVERNMENTAL BODY WILL INCUR ANY OBLIGATION TO THE PURCHASER WITH RESPECT TO THE APPROVAL OF THE FINAL SUBDIVISION PLAT. CHANGES BETWEEN THE PRELIMINARY PLAT AND FINAL SUBDIVISION PLATS ARE POSSIBLE. THE AGREEMENT MAY BE TERMINATED WITHOUT BREACH BY THE PURCHASER IF THE RECORDED FINAL SUBDIVISION PLAT DIFFERS IN ANY MATERIAL RESPECT FROM THE PRELIMINARY PLAT.

Preliminary Plat. Sections 4.5 and Section 4.6 of this Agreement are replacing the platting process within the Code. The Project shall follow the process set forth in Sections 4.5 and 4.6 of this Agreement. Notwithstanding anything in the Code to the contrary, the Preliminary Plat for the Property, together with the Preliminary Drainage Plans and the Preliminary Infrastructure Plans shall be submitted at the same time to the City and together shall be deemed to serve as the Preliminary Plat.
