Preliminary Price Notices; Placement of Purchase Orders. (a) Prior to each Fiscal Month, Inotera shall deliver to the Purchaser a notice (each, a “Preliminary Price Notice”), which shall set forth the Preliminary Price for Conforming Wafers, the Preliminary Price for Pre-Qual Engineering Wafers and the Preliminary Price for Non-Conforming Wafers for such Fiscal Month. The Parties hereby acknowledge that Inotera has timely delivered to the Purchaser a Preliminary Price Notice for the Fiscal Month commencing on the Effective Date.
