Preparation and Submission of Agreements. The actual process of preparing a closing agreement for the taxpayer's signature may differ considerably among cases. In some instances, the taxpayer's representative may prepare the entire agreement and submit it before or after execution for inspection by an Internal Revenue Agent examining his tax return. In some instances, the taxpayer or his representative will rely upon the examining officer to draft the agreement. In most situations, however, it would appear preferable for the examining officer and the taxpayer or his representative to collaborate in drafting the agreement.
