Common use of Prepayment of Term Clause in Contracts

Prepayment of Term. Loan No. 2 shall be subject to the same terms and provisions as prepayment of the Term Loan under Section 5.2(a) of this Agreement, including payment of a prepayment fee in the amount of 5% of the amount prepaid if prepayment occurs on or prior to December 28, 2006, 3% of the amount prepaid if prepayment occurs after December 28, 2006, and on or before December 28, 2007, and 1% of the amount prepaid if prepayment occurs after December 28, 2007, all as more particularly provided in Section 5.2(a)." hereby is amended and restated in its entirety to read as follows:
