Preservation of Marks. Each Assignor agrees to use its Marks in interstate commerce (or the equivalent thereof in any foreign jurisdiction) during the time in which this Agreement is in effect, sufficiently to preserve such Marks as trademarks or service marks under the laws of the United States or under the laws of the applicable foreign country, as the case may be; provided, that, to the extent permitted by the Credit Agreement, no Assignor shall be obligated to preserve any Xxxx in the event such Assignor determines, in its reasonable business judgment, that the preservation of such Xxxx is no longer desirable in the conduct of its business.
