Common use of Preservation of NMHC Property Clause in Contracts

Preservation of NMHC Property. Executive acknowledges that from time to time in the course of employment with NMHC, Executive has had the opportunity to inspect and use certain property of NMHC and the NMHC Entities, both tangible and intangible, including but not limited to files, records, documents, drawings, specifications, lists, equipment, graphics, designs, and similar items relating to the business of the NMHC Entities. Executive acknowledges and agrees that all such property, including but not limited to any and all copies thereof, whether prepared by Executive or otherwise in the possession of Executive, are and shall remain the exclusive property of NMHC or the applicable NMHC Entity, that Executive shall have no right or proprietary interest in such property and that Executive will safeguard and return to NMHC all such property upon the earlier of (i) NMHC’s request and (ii) the termination or expiration of Executive’s employment with NMHC.
