Common use of Previously Earned Bonus Clause in Contracts

Previously Earned Bonus. Notwithstanding any other provision of this Section 10, in the event that Executive’s employment pursuant to this Agreement is terminated at a time when Executive shall have earned a bonus under the Annual Incentive Plan for performance during the prior fiscal year which has not yet been paid, Executive shall be paid such bonus in addition to the amounts otherwise provided for in this Section 10. Such bonus shall be paid in the fiscal year following the fiscal year for which it is earned, and not later than March 15 of such year, in accordance with the Company’s normal practices. For the sake of clarity, any bonus of Executive under the Company’s Annual Incentive Plan shall deemed to have been earned on December 31 of the year upon whose performance such bonus is based if Executive has been continuously employed by the Company through December 31 of such year.
