Common use of Prices and Taxes Clause in Contracts

Prices and Taxes. a. The Company will not pay prices for Work higher than those prices stated in the Contract. Seller warrants that the prices of the items covered by this Contract are not in excess of Seller's lowest prices in effect on the date of this Contract for comparable quantities of similar items. If Seller reduces prices for this Work after formation of the Contract, but prior to payment, such price reductions will apply to this Contract. Unless otherwise specified, the prices include all charges for packaging, handling, storage and delivery.
