Common use of Prima Facie Evidence Clause in Contracts

Prima Facie Evidence. In any legal action or proceeding arising out of or in connection with this Loan Agreement, the entries made in the accounts maintained pursuant to Clause 24.3 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

Prima Facie Evidence. In any legal action or proceeding arising out of or in connection with this Loan Agreement, the entries made in the accounts records maintained pursuant to Clause 24.3 15.1 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

Prima Facie Evidence. In any legal action or proceeding arising out of or in connection with this Loan Agreementany Finance Document, the entries made in the accounts maintained pursuant to Clause 24.3 29.2 (Evidence of Debt) and Clause 24.4 29.3 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

In any legal action or proceeding arising out of or in connection with this Loan Agreement, the entries made in the accounts maintained pursuant to Clause 24.3 20.2 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

Prima Facie Evidence. In any legal action or proceeding Proceeding arising out of or in connection with this Loan Agreementthe Finance Documents, the entries made in the accounts maintained pursuant to Clause 24.3 (Evidence clause 25.1 above shall, in the absence of Debt) and Clause 24.4 (Control Accounts) shall manifest or proven error, be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

In any legal action or proceeding arising out of or in connection with this Loan AgreementDeed, the entries made in the accounts maintained pursuant to Clause 24.3 19.2 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the each Borrower.

Prima Facie Evidence. In any legal action or proceeding arising out of or in connection with this Loan Agreement, the entries made in the accounts records maintained pursuant to Clause 24.3 16.1 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

In any legal action or proceeding arising out of or in connection with this Loan Agreement, the entries made in the accounts maintained pursuant to Clause 24.3 27.3 (Evidence of Debt) and Clause 24.4 27.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Borrower.

Prima Facie Evidence. In any legal action or proceeding arising out of or in connection with this the Loan Facility Agreement, the entries made in the accounts maintained pursuant to Clause 24.3 25.1 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the Group Borrower.

In any legal action or proceeding arising out of or in connection with this Loan Agreement, the entries made in the accounts maintained pursuant to Clause 24.3 26.2 (Evidence of Debt) and Clause 24.4 (Control Accounts) shall be prima facie evidence of the existence and amounts of the specified obligations of the BorrowerBorrower and any each other Chargor under this Agreement.
