Common use of Prior Actions Clause in Contracts

Prior Actions. Paragraph 1.2 hereof notwithstanding, the Charter School shall not provide instruction to any student and shall not be eligible to receive funds from the local school districts as provided in §2856 of the Act until and unless SED shall issue a written statement to the Charter School, with a copy to the Regents, attesting to the Charter School's having completed or made satisfactory progress towards completing all or substantially all of the Prior Actions set forth in Section I, Opening Procedures, of the Oversight Plan (the "Prior Actions"). Upon such confirmation, the restrictions on the Charter School set forth in the immediately foregoing sentence shall be of no further force and effect. Moreover, notwithstanding anything to the contrary in this paragraph, the Prior Actions are in addition to any other conditions set forth in the Charter or the Act.
