Common use of Prior Hazardous Materials Clause in Contracts

Prior Hazardous Materials. Lessee shall have no obligation to clean up or to hold Lessor harmless with respect to, any Hazardous Material or wastes discovered on the Premises which were not introduced into, in, on, about, from or under the Premises during the Lease Term or ground water contamination from other parcels where the source is from off the Premises not arising from or caused by Lessee or Lessee's Agents.

Prior Hazardous Materials. Lessee shall have no obligation to clean up or to hold Lessor harmless with respect to, to any Hazardous Material or wastes discovered on the Premises Premises, except as a result of Environmental Surcharges, which were not introduced into, in, on, about, from or under the Premises during the Lease Term or ground water contamination from other parcels where the source is from off the Premises not arising from or caused by Lessee or Lessee's Agents.

Notwithstanding anything contained to the contrary herein, Lessee shall have no obligation to clean up or to hold Lessor harmless or make any payment with respect to, any Hazardous Material or wastes discovered on the Premises which were not introduced into, in, on, about, from or under the Premises during the Lease Term or ground water contamination from other parcels where the source is from off the Premises not arising from or caused by Lessee or Lessee's Agents.

Notwithstanding anything contained to the contrary herein, Lessee shall have no obligation to clean up or to hold Lessor harmless or make any payment with respect to, : (i) any Hazardous Material or wastes discovered on the Premises which were not introduced into, in, on, about, from or under the Premises during the Lease Term Term; or (ii) ground water contamination from other parcels where the source is from off the Premises not arising from or caused by Lessee or Lessee's Agents.
