Common use of Prior Patent Rights Clause in Contracts

Prior Patent Rights. Notwithstanding anything to the contrary in this Agreement, with respect to any SGI Patents that are subject to the SGI In-Licenses, the rights and obligations of the Parties under Section 9.2 and 9.3 shall be subject to SGI’s licensors’ rights to participate in and control prosecution, maintenance and enforcement of such SGI Patents, and to receive a share of damages recovered in such action, in accordance with the terms and conditions of the applicable SGI In-License.

Prior Patent Rights. Notwithstanding anything to the contrary in this Agreement, with respect to any SGI Licensed Patents that are subject to the SGI In-Licenses, the rights and obligations of the Parties under Section 9.2 11.2 and 9.3 11.3 shall be subject to SGI’s licensors’ 's licensees' rights to participate in and control prosecution, maintenance and enforcement of such SGI Patents, and to receive a share of damages recovered in such action, Licensed Patents in accordance with the terms and conditions of the applicable SGI In-License.

Notwithstanding anything to the contrary in this Agreement, with respect to any SGI Patents that are subject to the an SGI In-LicensesLicense or Licensed Technology Acquisition Agreement, the rights and obligations of the Parties under Section 9.2 and 9.3 shall be subject to SGI’s licensors’ rights to participate in and control prosecution, maintenance and enforcement of such SGI Patents, and to receive a share of damages recovered in such action, in accordance with the terms and conditions of the applicable SGI In-License.

Prior Patent Rights. Notwithstanding anything to the contrary in this Agreement, with respect to any SGI Patents that are subject to the SGI In-Licenses, the rights and obligations of the Parties under Section 9.2 and 9.3 shall be subject to SGI’s licensors’ the rights of the licensor of the SGI In-License to participate in and control prosecution, maintenance and enforcement of such SGI Patents, and to receive a share of damages recovered in such action, in accordance with the terms and conditions of the applicable SGI In-License.
