Common use of Priority of indemnity Clause in Contracts

Priority of indemnity. The Security Trustee may, in priority to any payment to the Secured Parties, indemnify itself out of the Trust Property in respect of, and pay and retain, all sums necessary to give effect to the indemnity in Clause 18.1 (Obligor indemnity) from the Obligors and shall have a lien on the Transaction Security and the proceeds of the enforcement of the Transaction Security for all moneys payable to it under this Clause.

Priority of indemnity. The Security Trustee and every Receiver may, in priority to any payment to the other Secured Parties, indemnify itself out of the Trust Charged Property in respect of, and pay and retain, all sums necessary to give effect to the indemnity in Clause 18.1 clause 9.1 (Obligor indemnityIndemnity to the Security Trustee) from the Obligors and shall have a lien on the Transaction Security constituted by this deed and the proceeds of the enforcement of the Transaction Security constituted by this deed for all moneys payable to it under this Clauseit.
