PRIVACY CLAUSE. 53.1 The Organisation and/or Cardholder confirms that he/she has read, understood and agreed to be bound by BSN Privacy Notice (which is available at xxx.xxxxx.xxx.xx) and the clauses herein, as may relate to the processing of the Cardholder’s personal information. For the avoidance of doubt, the Organisation and/or Cardholder agree that the said Privacy Notice shall be deemed to be incorporated by reference into this Agreement. 53.2 In the event the Organisation and/or Cardholder provides personal and financial information relating to third parties, including information relating to the Cardholder’s next-of-kin and dependents (where the Cardholder is an individual) or information relating to the Organisation and/or Cardholder’s directors, shareholders, officers, individual guarantors and security providers (where the Cardholder is a corporation), for the purpose of opening or operating the Organisation’s account(s)/facility(ies) with BSN or otherwise subscribing to the BSN’s Products and Services, the Cardholder:- (a) confirms that he/she has obtained their consent or are otherwise entitled to provide this information to BSN and for BSN to use it in accordance with this agreement; (b) agrees to ensure that the personal and financial information of the said third parties is accurate; (c) agrees to update BSN in writing in the event of any material change to the said personal and financial information; and (d) agrees to the BSN’s right to terminate this Agreement should such consent be withdrawn by any of the said third parties. 53.3 Where the Organisation and/or Cardholder instructs BSN to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by overseas regulators and authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN and/or the BSN’s agents to enter into any cross-border transaction on the Organisation and/or Cardholder’s behalf, the Organisation and/or Cardholder agree to the above said disclosures on behalf of the Organisation and/or Cardholder and others involved in the said cross-border transaction. 53.4 Even after the Organisation and/or Cardholder has provided BSN with any information, the Organisation and/or Cardholder will have the option to withdraw the consent given earlier. In such instances, BSN will have the right to not provide or discontinue the provision of any Product, Service, account(s) and/or facility(ies) that is/are linked with such information. 53.5 BSN reserves the right to amend this clause from time to time and shall provide prior notification to the Organisation and/or Cardholder in writing and place any such amendments on the BSN’s websites and/or by placing notices at the banking halls or at prominent locations within the BSN’s branches. 53.6 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

(d) agrees to the BSN’s right to terminate this Agreement should such consent be withdrawn by any of the said third parties.
53.3 52.3 Where the Organisation and/or Cardholder instructs BSN to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by overseas regulators and authorities in connection with their legitimate duties (e.g. the prevention of crime). .
52.4 In instructing BSN and/or the BSN’s agents to enter into any cross-border transaction on the Organisation and/or Cardholder’s behalf, the Organisation and/or Cardholder agree agrees to the above said disclosures on behalf of the Organisation and/or Cardholder and others involved in the said cross-border transaction.
53.4 52.5 BSN may use a credit reporting/reference agency to help make decisions, for example when BSN needs to:-
(a) check details on applications for credit and credit-related or other facilities;
(b) manage credit and credit-related accounts or facilities, including conducting reviews of the Cardholder’s portfolio(s); and/or
(c) recover debts.
52.6 The Cardholder will be linked by credit reporting/reference agencies to any other names the Cardholder use or have used, and any joint and several applicants. BSN may also share information about the Cardholder and how the Cardholder manages his/her account(s) or /facility (ies) with relevant credit reporting/reference agencies.
52.7 Even after the Organisation and/or Cardholder has provided BSN with any information, the Organisation and/or Cardholder will have the option to withdraw the consent given earlier. In such instances, BSN will have the right to not provide or discontinue the provision of any Productproduct, Serviceservice, account(s) and/or facility(iesfacility (ies) that is/are linked with such information.

Facility (a) confirms that he/she the Guarantor has obtained their consent or are is otherwise entitled to provide this information to BSN the Bank and for BSN the Bank to use it in accordance with this agreement;
Guarantee; (b) agrees agree to ensure that the personal and financial information of the said third parties is accurate;
; (c) agrees agree to update BSN the Bank in writing in the event of any material change to the said personal and financial information; and
and (d) agrees agree to the BSNBank’s right to terminate this Agreement the Facility should such consent be withdrawn by any of the said third parties.
53.3 15.3 Where the Organisation and/or Cardholder Guarantor instructs BSN the Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by overseas regulators and authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN the Bank and/or the BSNBank’s agents to enter into any cross-border transaction on behalf of the Organisation and/or Cardholder’s behalfGuarantor, the Organisation and/or Cardholder agree Guarantor agrees to the above said disclosures on behalf of the Organisation and/or Cardholder Guarantor and others involved in the said cross-border transaction.
53.4 15.4 The Bank may at any time and from time to time now and/or in the future carry out the necessary reference checks including but not limited to credit reporting/reference checks with credit reporting/reference agencies including but not limited to CTOS, FIS and/or any other agencies and/or from any financial institution to enable us to ascertain the Guarantor’s status as may be required to help make decisions, for example when the Bank needs to (a) check details on applications for credit and credit- related or other facilities; (b) manage credit and credit-related accounts or facilities, including conducting reviews of the Guarantor’s portfolio(s); and/or recover debts. The Guarantor will be linked by credit reporting/reference agencies to any other names the Guarantor uses or has used, and any joint and several applicants. The Bank may also share information about the Guarantor and how the Guarantor discharges and manages the Guarantor’s obligations herein with relevant credit reporting/reference agencies, and for any of these credit reporting/reference agencies to disclose the Guarantor’s credit information to its subscribers for purposes of fraud detection and fraud prevention.
15.5 Even after the Organisation and/or Cardholder Guarantor has provided BSN the Bank with any information, the Organisation and/or Cardholder Guarantor will have the option to withdraw the consent given earlier. In , except where such instances, BSN will have disclosure of the right to not provide or discontinue Guarantor’s information is necessary for the provision of the Facility and/or related services or the performance of the contract with the Borrower and/or Guarantor to comply with contractual requirements or to comply with any Product, Service, account(s) and/or facility(ies) that is/are linked with such informationlegal requirements.
53.5 BSN 15.6 The Bank reserves the right to amend this clause from time to time at its sole discretion and shall provide not less than twenty-one (21) days’ prior notification written notice to the Organisation and/or Cardholder in writing Guarantor and place any such amendments on the BSNBank’s websites and/or by placing notices at the banking halls or at prominent locations within the BSNBank’s branches
15.7 For the purposes of this clause, the CIMB Group consists of CIMB Group Holdings Berhad and all its related companies as defined in Section 7 of the Companies Act 2016 and jointly controlled companies that provide financial and other regulated services, excluding companies, branches, offices and other forms of presence operating outside Malaysia, and the use of the words “the Bank” and “the Bank’s” are to be read as references to the CIMB Group.
53.6 15.8 This clause shall be is without prejudice to any other clause in this Agreement Guarantee and Indemnity which provides for the disclosure of information.

53.2 (b) In the event the Organisation Customer provide personal and/or Cardholder provides personal and financial information relating to third parties, including but not limited to information relating to the CardholderCustomer’s next-of-kin and dependents (where the Cardholder is an individual) or information relating to the Organisation and/or Cardholder’s kin, dependants, authorised signatories, directors, shareholders, officers, individual guarantors and security providers (where the Cardholder is a corporation), Security Parties for the purpose of opening or operating the Organisation’s account(s)/facility(ies) with BSN or otherwise subscribing to the BSN’s Products and ServicesFacility, the Cardholder:-Customer:
(a) confirms i. confirm that he/she the Customer has obtained their consent or are otherwise entitled to provide this the information to BSN the Bank and for BSN the Bank to use it in accordance with this agreementLetter of Offer and to provide information on the Bank’s products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Bank and/or entity within AmBank Group believe may be of interest and/or beneficial to them;
(b) agrees ii. agree to ensure that the personal and financial information of the said third parties is accurate;
(c) agrees iii. agree to update BSN the Bank in writing in the event of any material change to the said personal and financial information; and
(d) agrees iv. agree to the BSNBank’s right to terminate this Agreement the Facility should such consent be withdrawn by any of the said third parties.
53.3 (c) Where Customer instruct the Organisation and/or Cardholder instructs BSN Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Bank’s agents abroad, overseas regulators and and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN the Bank and/or the BSN’s our agents to enter into any cross-cross- border transaction on the Organisation and/or CardholderCustomer’s behalf, the Organisation and/or Cardholder Customer agree to the above said disclosures on behalf of the Organisation and/or Cardholder Customer and others involved in the said cross-border transaction.
53.4 (d) Additionally, but always subject to any laws, (including regulations, guidelines and/or obligations) applicable to the Bank (whether in or outside Malaysia), Customer agree that other companies in AmBank Group, their merchants and strategic partners may contact the Customer about products, services and offers, which the Bank and AmBank Group believe may be of interest or beneficial to the Customer.
(e) The Bank and AmBank Group may communicate with Customer through various channels, including telephone, e-mail, electronic / mobile messaging, facsimile or post, using the contact information Customer has provided.
(f) Customer may inform the Bank at any time if Customer do not wish to receive marketing communications from the Bank, AmBank Group and/or their merchants and business partners, by contacting the Bank at the various channels given below:

ii. Phone : 0000 00 0000 (Domestic) or (000) 0000 0000 (Overseas) [24 hours]

(g) Customer’s latest written instructions to the Bank will prevail. Customer acknowledges that certain communications such as the statements of Facility to the Customer and AmBank Group’s websites may contain standard information regarding other products and services of the Bank and AmBank Group that cannot be removed without affecting the delivery / operation provision of the Facility and/or without additional costs to Customer.
(h) The Bank may use a credit reporting agency to help make decisions, for example when the Bank needs to:
i. check details on applications for the Facility, financing and financing-related or other facilities granted to the Customer;
ii. managing and reviewing the Facility; and/or
iii. recover debts owed by the Customer.
(i) Customer will be linked by credit reporting agencies to any other names Customer use or may had used, and any joint and several applicants. The Bank may also share information about Customer and how Customer manages the Facility with relevant credit reporting agencies.
(j) Even after the Organisation and/or Cardholder Customer has provided BSN the Bank with any information, the Organisation and/or Cardholder Customer will have the option to withdraw the consent given earlier. In such instances, BSN the Bank will have the right to not provide or discontinue the provision of any Product, Service, account(s) and/or facility(ies) the Facility that is/are linked with such information.
53.5 BSN (k) The Bank reserves the right to amend this clause Clause from time to time and shall provide prior notification at the Bank’s sole discretion by providing notice to the Organisation and/or Cardholder in writing and place any such amendments on the BSN’s websites and/or by placing notices at the banking halls or at prominent locations within the BSN’s branchesCustomer.
53.6 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

The Bank may also share information about the Customer and how the Customer manages the Customer’s account(s)/facility(ies) with relevant credit reporting/reference agencies.
53.4 15.4 Even after the Organisation and/or Cardholder Customer has provided BSN the Bank with any information, the Organisation and/or Cardholder Customer will have the option to withdraw the consent given earlier. In such instances, BSN the Bank will have the right to not provide or discontinue the provision of any Productproduct, Serviceservice, account(s) and/or facility(ies) that is/are linked with such information.
53.5 BSN 15.5 The Bank reserves the right to amend this clause from time to time at the Bank’s sole discretion and shall provide twenty one (21) calendar days prior notification to the Organisation and/or Cardholder Customer in writing and place any such amendments on the BSNBank’s websites and/or by placing notices at the banking halls or at prominent locations within the BSNBank’s branches.
53.6 15.6 For the purposes of this Clause, the CIMB Group consists of CIMB Group Holdings Berhad and all its related companies as defined in Section 7 of the Companies Xxx 0000 and jointly controlled companies that provide financial and other regulated services, excluding companies, branches, offices and other forms of presence operating outside Malaysia, and the use of the words “the Bank” and “the Bank’s” are to be read as references to the CIMB Group.
15.7 The Customer further agrees that the Bank shall not in any event be liable from any claim, loss, damage (financial or otherwise), injuries, embarrassments or liability howsoever arising whether in contract, tort, negligence, strict liability or any basis (including direct or indirect, special, incidental, consequential or punitive damages or loss of profits or savings) arising from any inaccuracy or loss, deletion or modification of data or for any other reasons whatsoever relating to any information forwarded by the Bank to such credit reporting/reference agencies and/or such other party, as the case may be, or in relation to any access or use, or the inability to access or use by such credit reporting/reference agencies and/or such other party or reliance on the information contained therein, whether caused by any technical, hardware or software failure of any kind, the interruption, error, omission, delay, viruses or otherwise howsoever unless the same is caused directly by the Bank’s wilful default or gross neglect.
15.8 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

53.2 (b) In the event the Organisation Chargor provide personal and/or Cardholder provides personal and financial information relating to third parties, including but not limited to information relating to the CardholderChargor’s next-of-kin and dependents (where the Cardholder is an individual) or information relating to the Organisation and/or Cardholder’s kin, dependants, autjorized signatories, directors, shareholders, officers, individual guarantors and security providers (where the Cardholder is a corporation), Security Parties for the purpose of opening or operating the Organisation’s account(s)/facility(ies) with BSN or otherwise subscribing to the BSN’s Products and ServicesFacility, the Cardholder:-Chargor:
(ai) confirms confirm that he/she the Chargor has obtained their consent or are otherwise entitled to provide this the information to BSN the Chargee and for BSN the Chargee to use it in accordance with this agreementCharge and to provide information on the Chargee’s products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Chargee and/or entity within AmBank Group believe may be of interest and/or beneficial to them;
(bii) agrees agree to ensure that the personal and financial information of the said third parties is accurate;
(ciii) agrees agree to update BSN the Chargee in writing in the event of any material change to the said personal and financial information; and
(div) agrees agree to the BSNChargee’s right to terminate this Agreement the Facility should such consent be withdrawn by any of the said third parties.
53.3 (c) Where Chargor instruct the Organisation and/or Cardholder instructs BSN Chargee to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Chargee’s agents abroad, overseas regulators and and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN the Chargee and/or the BSN’s our agents to enter into any cross-cross- border transaction on the Organisation and/or CardholderChargor’s behalf, the Organisation and/or Cardholder Xxxxxxx agree to the above said disclosures on behalf of the Organisation and/or Cardholder Chargor and others involved in the said cross-border transaction.
53.4 (d) Additionally, but always subject to any laws, (including regulations, guidelines and/or obligations) applicable to the Chargee (whether in or outside Malaysia), Chargor agree that other companies in AmBank Group, their merchants and strategic partners may contact the Chargor about products, services and offers, which the Chargee and AmBank Group believe may be of interest or beneficial to the Chargor.
(e) The Chargee and AmBank Group may communicate with Chargor through various channels, including telephone, e-mail, electronic / mobile messaging, facsimile or post, using the contact information Xxxxxxx has provided.
(f) Chargor may inform the Chargee at any time if Chargor do not wish to receive marketing communications from the Chargee, AmBank Group and/or their merchants and business partners, by contacting the Chargee at the various channels given below:

Chargor acknowledges that certain communications such as the statements of Facility to the Chargor and AmBank Group’s websites may contain standard information regarding other products and services of the Chargee and AmBank Group that cannot be removed without affecting the delivery / operation provision of the Facility and/or without additional costs to Chargor.
(h) The Chargee may use a credit reporting agency to help make decisions, for example when the Chargee needs to:
i) check details on applications for the Facility, financing and financing-related or other facilities granted to the Chargor;
ii) managing and reviewing the Facility; and/or
iii) recover debts owed by the Chargor.
(i) Chargor will be linked by credit reporting agencies to any other names Chargor use or may had used, and any joint and several applicants. The Chargee may also share information about Chargor and how Xxxxxxx manages the Facility with relevant credit reporting agencies.
(j) Even after the Organisation and/or Cardholder Xxxxxxx has provided BSN the Chargee with any information, the Organisation and/or Cardholder Chargor will have the option to withdraw the consent given earlier. In such instances, BSN the Chargee will have the right to not provide or discontinue the provision of any Product, Service, account(s) and/or facility(ies) the Facility that is/are linked with such information.
53.5 BSN (k) The Chargee reserves the right to amend this clause Clause from time to time and shall provide prior notification at the Chargee’s discretion by providing notice to the Organisation and/or Cardholder in writing and place any such amendments on the BSN’s websites and/or by placing notices at the banking halls or at prominent locations within the BSN’s branchesChargor.
53.6 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

BSN may also share information about the Cardholder and how the Cardholder manages his/her account(s) or /facility (ies) with relevant credit reporting/reference agencies.
52.7 Even after the Organisation and/or Cardholder has provided BSN with any information, the Organisation and/or Cardholder will have the option to withdraw the consent given earlier. 53.4 15.4 The Bank may at any time and from time to time now and/or in the future carry out the necessary reference checks including but not limited to credit reporting/reference checks with credit reporting/reference agencies including but not limited to CCRIS, FIS and/or any other agencies and/or from any financial institution to enable us to ascertain the Customer’s status as may be required to help make decisions, for example when the Bank needs to (a)check details on applications for credit and credit- related or other facilities; (b) manage credit and credit-related accounts or facilities, including conducting reviews of the Customer’s portfolio(s); and/or recover debts. The Customer will be linked by credit reporting/reference agencies to any other names the Customer uses or has used, and any joint and several applicants. The Bank may also share information about the Customer and how the Customer manages the Customer’s account(s)/facility(ies) with relevant credit reporting/reference agencies.
15.5 Even after the Organisation and/or Cardholder Customer has provided BSN the Bank with any information, the Organisation and/or Cardholder Customer will have the option to withdraw the consent given earlier. In such instances, BSN the Bank will have the right to not provide or discontinue the provision of any Productproduct, Serviceservice, account(s) and/or facility(ies) that is/are linked with such information.
53.5 BSN 15.6 The Bank reserves the right to amend this clause from time to time at the Bank’s sole discretion and shall provide prior notification to the Organisation and/or Cardholder Customer in writing and place any such amendments on the BSNBank’s websites and/or by placing notices at the banking halls or at prominent locations within the BSNBank’s branches
15.7 For the purposes of this Clause, the CIMB Group consists of CIMB Group Holdings Berhad and all its related companies as defined in Xxx 0 xx xxx Xxxxxxxxx Xxx 0000 and jointly controlled companies that provide financial and other regulated services, excluding companies, branches, offices and other forms of presence operating outside Malaysia, and the use of the words “ the Bank” and “ the Bank’s” are to be read as references to the CIMB Group.
53.6 15.8 The Customer further agrees that the Bank shall not in any event be liable from any claim, loss, damage (financial or otherwise), injuries, embarrassments or liability howsoever arising whether in contract, tort, negligence, strict liability or any basis (including direct or indirect, special, incidental, consequential or punitive damages or loss of profits or savings) arising from any inaccuracy or loss, deletion or modification of data or for any other reasons whatsoever relating to any information forwarded by the Bank to such credit reporting/reference agencies and/or such other party, as the case may be, or in relation to any access or use, or the inability to access or use by such credit reporting/reference agencies and/or such other party or reliance on the information contained therein, whether caused by any technical, hardware or software failure of any kind, the interruption, error, omission, delay, viruses or otherwise howsoever.
15.9 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

(j) Even after the Organisation and/or Cardholder Assignor has provided BSN the Bank with any information, the Organisation and/or Cardholder Assignor will have the option to withdraw the consent given earlier. In such instances, BSN the Bank will have the right to not provide or discontinue the provision of any Product, Service, account(s) and/or facility(ies) the Facility that is/are linked with such information.
53.5 BSN (k) The Bank reserves the right to amend this clause Section from time to time and shall provide prior notification at the Bank’s sole discretion by providing notice to the Organisation and/or Cardholder in writing and place any such amendments on the BSN’s websites and/or by placing notices at the banking halls or at prominent locations within the BSN’s branchesAssignor.
53.6 (l) This clause section shall be without prejudice to any other clause in Section 13.13 (Disclosure of Information) of this Agreement which provides for the disclosure of informationAssignment.

53.2 In the event the Organisation and/or Cardholder provides personal and financial information relating to third parties, including information relating to the Cardholder’s next-of-kin and dependents (where the Cardholder is an individual) or information relating to the Organisation and/or Cardholder’s directors, shareholders, officers, individual guarantors and security providers (where the Cardholder is a corporation), for the purpose of opening or operating the OrganisationCardholder’s account(s)/facility(ies) with BSN or otherwise subscribing to the BSN’s Products products and Servicesservices, the Cardholder:-
(a) confirms that he/she has obtained their consent or are otherwise entitled to provide this information to BSN and for BSN to use it in accordance with this agreement;
(b) agrees to ensure that the personal and financial information of the said third parties is accurate;
(c) agrees to update BSN in writing in the event of any material change to the said personal and financial information; and
(d) agrees to the BSN’s right to terminate this Agreement should such consent be withdrawn by any of the said third parties.
53.3 Where the Organisation and/or Cardholder instructs BSN to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by overseas regulators and authorities in connection with their legitimate duties (e.g. the prevention of crime). .
53.4 In instructing BSN and/or the BSN’s agents to enter into any cross-border transaction on the Organisation and/or Cardholder’s behalf, the Organisation and/or Cardholder agree agrees to the above said disclosures on behalf of the Organisation and/or Cardholder and others involved in the said cross-border transaction.
53.4 53.5 BSN may use a credit reporting/reference agency to help make decisions, for example when BSN needs to:-
(a) check details on applications for credit and credit-related or other facilities;
(b) manage credit and credit-related accounts or facilities, including conducting reviews of the Cardholder’s portfolio(s); and/or
(c) recover debts.
53.6 The Cardholder will be linked by credit reporting/reference agencies to any other names the Cardholder use or have used, and any joint and several applicants. BSN may also share information about the Cardholder and how the Cardholder manage his/her account(s) or/facility(ies) with relevant credit reporting/reference agencies.
53.7 Even after the Organisation and/or Cardholder has provided BSN with any information, the Organisation and/or Cardholder will have the option to withdraw the consent given earlier. In such instances, BSN will have the right to not provide or discontinue the provision of any Productproduct, Serviceservice, account(s) and/or facility(ies) that is/are linked with such information.

53.4 (d) Additionally, but always subject to any laws, (including regulations, guidelines and/or obligations) applicable to the Bank (whether in or outside Malaysia), Customer agree that other companies in AmBank Group, their merchants and strategic partners may contact the Customer about products, services and offers, which the Bank and AmBank Group believe may be of interest or beneficial to the Customer.
(e) The Bank and AmBank Group may communicate with Customer through various channels, including telephone, e-mail, electronic / mobile messaging, facsimile or post, using the contact information Customer has provided.
(f) Customer may inform the Bank at any time if Customer do not wish to receive marketing communications from the Bank, AmBank Group and/or their merchants and business partners, by contacting the Bank at the various channels given below:

i) check details on applications for the Facility, financing and financing-related or other facilities granted to the Customer;
ii) managing and reviewing the Facility; and/or iii) recover debts owed by the Customer.
(i) Customer will be linked by credit reporting agencies to any other names Customer use or may had used, and any joint and several applicants. The Bank may also share information about Customer and how Customer manages the Facility with relevant credit reporting agencies.

53.6 16.7 For the purposes of this Clause, the CIMB Group consists of CIMB Group Holdings Berhad and all its related companies as defined in Xxx 0 xx xxx Xxxxxxxxx Xxx 0000 and jointly controlled companies that provide financial and other regulated services, excluding companies, branches, offices and other forms of presence operating outside Malaysia, and the use of the words “ the Bank” and “ the Bank’s” are to be read as references to the CIMB Group.

53.2 (b) In the event the Organisation and/or Cardholder provides Chargor provide personal and and/ or financial information relating to third parties, including but not limited to information relating to the CardholderChargor’s next-of-kin and dependents (where the Cardholder is an individual) or information relating to the Organisation and/or Cardholder’s kin, dependants, authorised signatories, directors, shareholders, officers, individual guarantors and security providers (where the Cardholder is a corporation), Security Parties for the purpose of opening or operating the Organisation’s account(s)/facility(ies) with BSN or otherwise subscribing to the BSN’s Products and ServicesFacility, the Cardholder:-Chargor:
(a) confirms that he/she i. confirm t hat the Chargor has obtained their consent or are otherwise entitled to provide this the information to BSN the Chargee and for BSN the Chargee to use it in accordance with this agreementCharge and to provide information on the Chargee’s products, services and/ or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Chargee and/ or entity within AmBank Group believe may be of interest and/ or beneficial to them;
(b) agrees ii. agree to ensure that the personal and financial information of the said third parties is accurate;
(c) agrees iii. agree to update BSN the Chargee in writing in the event of any material change to the said personal and financial information; and
(d) agrees iv. agree to the BSNChargee’s right to terminate this Agreement the Facility should such consent be withdrawn by any of the said third parties.
53.3 (c) Where Chargor instruct the Organisation and/or Cardholder instructs BSN Chargee to effect any sort of cross-border cross -border transaction (including to make or receive payments), the details relevant to the cross-border cross -border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Chargee’s agents abroad, overseas regulators and and/ or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN and/or the BSN’s Chargee and/ or our agents to enter into any cross-cross - border transaction on the Organisation and/or CardholderChargor’s behalf, the Organisation and/or Cardholder Xxxxxxx agree to the above said disclosures on behalf of the Organisation and/or Cardholder Chargor and others involved in the said cross-border cross -border transaction.
53.4 (d) Add itionally, but always subject to any laws, (including regulations, guidelines and/ or obligations) applicable to the Chargee (whether in or outside Malaysia), Chargor agree that other companies in AmBank Group, their merchants and strategic partners may con tact the Chargor about products, services and offers, which the Chargee and AmBank Group believe may be of interest or beneficial to the Chargor.
(e) The Chargee and AmBank Group may communicate with Chargor through various channels, including telephone, e -mail, electronic / mobile messaging, facsimile or post, using the contact information Xxxxxxx has provided.
(f) Chargor may inform the Chargee at any time if Chargor do not wish to receive marketing communications from the Bank, AmBank Group and/ or their merc hants and business partners, by contacting the Chargee at the various channels given below:

Chargor acknowledges that certain communications such as the statements of Facility to the Chargor and AmBank Group’s websites may contain standard information regarding other products and services of the Chargee and AmBank Group that cannot be removed without affecting the delivery / operation provision of the Facility and/ or without additional costs to Chargor .
(h) The Chargee may use a credit reporting agency to help make decisions, for example when the Chargee needs to:
i. check details on applications for the Facility, financing and financing -related or other facilities granted to the Chargor;
ii. managing and revie wing the Facility; and/ or
iii. recover debts owed by the Chargor.
(i) Chargor will be linked by credit reporting agencies to any other names Chargor use or may had used, and any joint and several applicants. The Chargee may also share information about Chargor and how Xxxxxxx manages the Facility with relevant credit reporting agencies.
(j) Even after the Organisation and/or Cardholder Xxxxxxx has provided BSN the Chargee with any information, the Organisation and/or Cardholder Chargor will have the option to withdraw the consent given earlier. In such instances, BSN the Chargee will have the right to not provide or discontinue the provision of any Product, Service, account(s) and/or facility(ies) the Facility that is/is/ are linked with such information.
53.5 BSN (k) The Chargee reserves the right to amend this clause Clause from time to time and shall provide prior notification at the Chargee’s discretion by providing notice to the Organisation and/or Cardholder in writing and place any such amendments on the BSN’s websites and/or by placing notices at the banking halls or at prominent locations within the BSN’s branchesChargor.
53.6 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

(iii) recover debts owed by the Chargor and/or the Customer.
(i) The Chargor and/or Customer will be linked by credit reporting agencies to any other names the Chargor and/or Customer use or may had used, and any joint and several applicants. The Chargee may also share information about the Chargor and/or the Customer and how the Chargor and/or the Customer manage the Facility with relevant credit reporting agencies.
(j) Even after the Organisation Chargor and/or Cardholder has Customer have provided BSN the Chargee with any information, the Organisation Chargor and/or Cardholder Customer will have the option to withdraw the consent given earlier. In such instances, BSN the Chargee will have the right to not provide or discontinue the provision of any Product, Service, account(s) and/or facility(ies) the Facility that is/are linked with such information.
53.5 BSN (k) The Chargee reserves the right to amend this clause Section from time to time and shall provide prior notification at the Chargee’s sole discretion by providing notice to the Organisation Chargor and/or Cardholder in writing and place any such amendments on the BSN’s websites and/or by placing notices at the banking halls or at prominent locations within the BSN’s branchesCustomer.
53.6 (l) This clause shall be without prejudice to any other clause in Section 11.14 (Disclosure of Information) of this Agreement which provides for the disclosure of informationCharge.

(a) confirms i. confirm that he/she the Chargor has obtained their consent or are otherwise entitled to provide this the information to BSN the Chargee and for BSN the Chargee to use it in accordance with this agreementCharge and to provide information on the Chargee’s products, services and/or offers 21 CB(BBA/ANNEXURE1st/POC/092018)AmI (inclusive of the products, services and offers of the other entities within AmBank Group) which the Chargee and/or entity within AmBank Group believe may be of interest and/or beneficial to them;
(b) agrees ii. agree to ensure that the personal and financial information of the said third parties is accurate;
(c) agrees iii. agree to update BSN the Chargee in writing in the event of any material change to the said personal and financial information; and
(d) agrees iv. agree to the BSNChargee’s right to terminate this Agreement the Facility should such consent be withdrawn by any of the said third parties.
53.3 (c) Where Chargor instruct the Organisation and/or Cardholder instructs BSN Chargee to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Chargee’s agents abroad, overseas regulators and and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing BSN the Chargee and/or the BSN’s our agents to enter into any cross-cross- border transaction on the Organisation and/or CardholderChargor’s behalf, the Organisation and/or Cardholder Xxxxxxx agree to the above said disclosures on behalf of the Organisation and/or Cardholder Chargor and others involved in the said cross-border transaction.
53.4 Even after (d) Additionally, but always subject to any laws, (including regulations, guidelines and/or obligations) applicable to the Organisation Chargee (whether in or outside Malaysia), Chargor agree that other companies in AmBank Group, their merchants and strategic partners may contact the Chargor about products, services and offers, which the Chargee and AmBank Group believe may be of interest or beneficial to the Chargor.
(e) The Chargee and AmBank Group may communicate with Chargor through various channels, including telephone, e-mail, electronic / mobile messaging, facsimile or post, using the contact information Xxxxxxx has provided.
(f) Chargor may inform the Chargee at any time if Chargor do not wish to receive marketing communications from the Bank, AmBank Group and/or Cardholder has provided BSN with any informationtheir merchants and business partners, by contacting the Organisation and/or Cardholder Chargee at the various channels given below:

In such instances, BSN will have Chargor and AmBank Group’s websites may contain standard information regarding other products and services of the right to Chargee and AmBank Group that cannot provide or discontinue be removed without affecting the delivery / operation provision of any Product, Service, account(s) the Facility and/or facility(ies) that is/are linked with such informationwithout additional costs to Chargor .
53.5 BSN reserves (h) The Chargee may use a credit reporting agency to help make decisions, for example when the right to amend this clause from time to time Chargee needs to:
i. check details on applications for the Facility, financing and shall provide prior notification financing-related or other facilities granted to the Organisation and/or Cardholder in writing Chargor;
ii. managing and place any such amendments on reviewing the BSN’s websites and/or Facility; and/or
iii. recover debts owed by placing notices at the banking halls or at prominent locations within the BSN’s branchesChargor.
53.6 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information.

(d) agrees to the BSN’s right to terminate this Agreement should such consent be withdrawn by any of the said third parties.
