Common use of Privacy Rule Obligations Clause in Contracts

Privacy Rule Obligations. To the extent that Business Associate is to carry out one or more of the Covered Entity’s obligations under the Privacy Rule, Business Associate shall comply with the requirements of the Privacy Rule that apply to Covered Entity in the performance of such obligation(s), as required by HIPAA Section 164.

Privacy Rule Obligations. Furthermore, as required any specific listing of duties or functions to be performed by HIPAA Section 164Business Associate for Covered Entity contained in a separate contract (or addendum thereto) between the Parties is hereby incorporated by reference into this Agreement for the sole purpose of further elaborating duties and functions that Business Associate is contractually undertaking on behalf of the Covered Entity.
