Common use of Privacy Clause in Contracts

Privacy. 14.1 When dealing with Personal Information in carrying out the Activity, the Grantee agrees: (a) to comply with the requirements of the Privacy Act 1988 (Cth); (b) not to do anything which, if done by the Commonwealth, would be a breach of an Australian Privacy Principle; (c) to ensure that any of the Grantee’s subcontractors or personnel who deal with Personal Information for the purposes of this Agreement are aware of the requirements of the Privacy Act 1988 (Cth) and the Grantee’s obligations under this clause; (d) to immediately notify the Commonwealth if the Grantee becomes aware of an actual or possible breach of this clause by the Grantee or any of the Grantee’s subcontractors or personnel. 14.2 In carrying out the Activity, the Grantee agrees not to send any Personal Information outside of Australia without the Commonwealth’s prior written approval. The Commonwealth may impose any conditions it considers appropriate when giving its approval.
