Common use of Private Roads Clause in Contracts

Private Roads. All roads within the Property shall be constructed by the Owner, Developer(s) or other parties and maintained by such party(ies) and/or Association(s) or dedicated for maintenance to other appropriate entities. Except as provided in this Agreement, the City will not be responsible for the construction of any private roads within the Property, unless the City specifically agrees to do so in the future. Owner acknowledges that any private road shall comply with all applicable state statutes and rules and regulations of the South Carolina Department of Transportation or its successor regarding standards and safety of such roads. Roadway section details shall be submitted for review at the time of development permit applications, as provided in the PDD standards.
