PRIVATE SEWAGE DISPOSAL SYSTEM. The City represents and warrants to Buyer that the Rolfing Street property is not served by a private sewage disposal system, and there are no known private sewage disposal systems on the property.
PRIVATE SEWAGE DISPOSAL SYSTEM. Seller represents and warrants to Buyer that the Real Estate is served by a private sewage disposal system. Prior to closing, Buyer shall obtain at Buyer's expense a certified inspector's report which documents the condition of the private sewage disposal system, that it is of sufficient capacity to serve the Real Estate, that the continued use of the system is permitted, and whether any modifications are required to conform to standards adopted by the Department of Natural Resources. Buyer shall attach the inspection report to the Groundwater Hazard Statement to be filed at closing. Buyer is solely responsible for any pumping, alterations, modifications, repairs, or replacement of the private sewage disposal system.
