Probationary Teacher Clause Samples

The Probationary Teacher clause defines the terms and conditions under which a newly hired teacher is considered to be on probation. Typically, this clause outlines the duration of the probationary period, the performance expectations, and the evaluation process that the teacher must undergo during this time. For example, it may specify that the teacher's employment is subject to review after a set number of months, and that continued employment depends on satisfactory performance. The core function of this clause is to provide the employer with an opportunity to assess the teacher's suitability for a permanent position while giving the teacher clear guidelines and expectations during the initial phase of employment.
Probationary Teacher. If the PAR Panel recommends contract nonrenewal for a probationary teacher, the teacher will be given the opportunity to appear before the PAR Panel. If the teacher chooses to appear before the PAR Panel, the principal also will be given the opportunity to present information to the PAR Panel. If the PAR Panel affirms its original recommendation for nonrenewal, that recommendation is forwarded to the superintendent. A majority vote of the PAR Panel shall be required to overturn its preliminary recommendation and uphold the teacher who has submitted the information.
Probationary Teacher. The term “probationary teacher” shall mean a teacher who has been properly informed that they are not performing satisfactorily.
Probationary Teacher. A probationary teacher shall have a summative evaluation at least one (1) time during each probationary year and shall meet the requirements as set forth in the Evaluation Plan. Normally, there shall be a twenty (20) work day period between observations when more than one is done in any school year.

Each teacher on probation shall be evaluated at least two times by April 15th except for teachers who begin employment after January 1st; those teachers will be evaluated twice by the end of the calendar year. A probationary teacher shall neither be protected by the just cause provision of this Agreement nor have access to the grievance/arbitration provision with regard to the non-renewal or termination of his/her employment during this probationary period.
