Common use of Procedural Error Clause in Contracts

Procedural Error. If a procedural error occurs in the implementation of a Probationary Plan of Improvement, the error does not invalidate the probationary employee’s Plan of Improvement or evaluation activities unless the error materially affects the effectiveness of the Probationary Plan of Improvement or the ability to evaluate the probationary employee’s performance.
