If Contractor does not deliver a Notice of Election relating to any claim within the required notice period, the AOC Indemnitee shall have the right to defend the claim in such manner as it may deem appropriate. Contractor shall promptly reimburse the AOC Indemnitee for all such costs and expenses incurred by the AOC Indemnitee, including attorneys’ fees.
