Procedures for Non-Party Claims other than Ordinary Course Customer Claims. The following procedures shall apply to all matters or circumstances that may result in a Loss by reason of a Claim brought by a Third Party, including but not limited to a Claim that may be asserted by a Governmental Authority (“Non-Party Claims”; provided that the term “Non-Party Claim” shall include a Claim that may be asserted by an employee of a Party or Company Entity) and provided further that if the Non-Party Claim is determined to be an Ordinary Course Customer Claim pursuant to the provisions of Section 6.7, the provisions of Section 6.7 shall apply in lieu of the provisions of Section 6.6:
