Common use of Producing Wxxxx Clause in Contracts

Producing Wxxxx. All producing wxxxx that constitute part of the Borrowing Base Oil and Gas Properties (a) have been, during all times that any such wxxxx were operated by Borrower or its Affiliates, and (b) to the knowledge of Borrower, have been at all other times, drilled, operated and produced in conformity with all applicable Laws, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Borrowing Base Oil and Gas Properties, or on Oil and Gas Properties which have been pooled, unitized or communitized with the Borrowing Base Oil and Gas Properties, except to the extent that any noncompliance with the representations set out in this Section 5.22 would not have a Material Adverse Effect.

Producing Wxxxx. All producing wxxxx that constitute part of the Borrowing Base Borrower Oil and Gas Properties Properties: (a) have been, during all times that any such wxxxx were operated by Borrower Borrowers or its Affiliatestheir Subsidiaries, and (b) to the knowledge of Borrower, have been at all other times, ; drilled, operated and produced in conformity with all applicable Laws, rules, regulations and orders of all regulatory authorities having jurisdiction, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Borrowing Base Borrower Oil and Gas Properties, or on Oil and Gas Properties which have been pooled, unitized or communitized with the Borrowing Base Borrower Oil and Gas Properties, except to the extent that any noncompliance with the representations set out in this Section 5.22 would not have a Material Adverse Effect.
