All producing xxxxx that constitute part of the Borrowing Base Properties: (a) have been, during all times that any such xxxxx were operated by any Loan Party or its Affiliates, and (b) to the knowledge of the Loan Parties, have been at all other times, drilled, operated and produced in conformity with all applicable Laws, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Borrowing Base Properties, or on Oil and Gas Properties which have been pooled, unitized or communitized with the Borrowing Base Properties, except to the extent that any noncompliance with the representations set forth in this Section 6.18 [Producing Xxxxx] would not reasonably be expected to result in a Material Adverse Change.
Producing Xxxxx. All producing xxxxx that constitute part of the Borrowing Base Oil and Gas Properties: (a) have been, during all times that any such xxxxx were operated by Borrower or its Affiliates, and (b) to the knowledge of the Borrower, have been at all other times; drilled, operated and produced in conformity with all applicable Laws, rules, regulations and orders of all regulatory authorities having jurisdiction, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Borrowing Base Oil and Gas Properties, or on Oil and Gas Properties which have been pooled, unitized or communitized with the Borrowing Base Oil and Gas Properties, except to the extent that any noncompliance with the representations set out in this Section would not have a Material Adverse Effect.

All producing xxxxx that constitute part of the Oil and Gas Properties (a) have been, during all times that any such xxxxx were operated by Borrower or its Affiliates, and (b) to the knowledge of Borrower, have been at all other times, drilled, operated and produced in conformity with all applicable Laws, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Oil and Gas Properties, or on Oil and Gas Properties which have been pooled, unitized or communitized with the Oil and Gas Properties, except to the extent that any noncompliance with the representations set out in this Section 5.22 would not have a Material Adverse Effect.

All producing xxxxx that constitute part of the Oil and Gas Properties (a) have been, during all times that any such xxxxx were operated by Borrower or its Affiliates, and (b) to the knowledge of Borrower, have been at all other times, drilled, operated and produced in conformity with all applicable Laws, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Oil and Gas Properties, or on Leases which have been pooled, unitized or communitized with the Oil and Gas Properties.

Producing Xxxxx. All producing xxxxx located on the Borrowing Base Oil and Gas Properties have been, during all times that such were under the direction or control of the Borrower owning or operating such Borrowing Base Oil and Gas Properties and, to the knowledge of such Borrower, at all other times, drilled, operated and produced in conformity with all applicable Laws, rules, regulations and orders of all regulatory authorities having jurisdiction, are subject to no penalties on account of past production, and are bottomed under and are producing from, and the well bores are wholly within, the Borrowing Base Oil and Gas Properties, or on Oil and Gas Properties which have been pooled, unitized or communitized with the Borrowing Base Oil and Gas Properties.
Producing Xxxxx. Each of the producing xxxxx located on the ---------------- Mortgaged Properties is actually producing oil and/or gas in paying quantities, is not shut-in, and is suitably equipped, in accordance with reasonable industry standards, to continue such production. No event known to the Grantor has occurred which would adversely affect the anticipated future production of any of such xxxxx that has not been previously disclosed to the Holder in writing.
Producing Xxxxx. All producing xxxxx located on the Lands have been drilled, operated and produced in conformity in all material respects with all applicable laws, rules, regulations and orders of all regulatory authorities having jurisdiction and are subject to no material penalties on account of past production, and such xxxxx are, in fact, bottomed under and are producing from, and the well bores are wholly within, the Lands.
Producing Xxxxx.
