Common use of PRODUCT CHANGE OR SUBSTITUTION Clause in Contracts

PRODUCT CHANGE OR SUBSTITUTION. Should the product originally awarded become unavailable or cannot be supplied by the Contractor for any reason (except as provided for in the Savings/Force Majeure clause of Appendix B), the new product and price calculation determined by the Commissioner in his/her sole discretion, to be most reflective of market conditions will be used.
