Common use of Product Dating Clause in Contracts

Product Dating. All Products supplied to Members must have an expiration date of at least three (3) years from the date of manufacture and have a least a six (6) month shelf life from the date of acceptance of the Product by the Member. For Products that have an expiration dates less than six (6) months, Vendor will (A) discount the Product no less than twenty percent (20%); (B) Member must be notified and provided written consent before delivery; and (C) Products must be usable for at least fifteen (15) days on the date received by Member.

Product Dating. All Products supplied to Members must have an expiration date of: (a) if such Product has a shelf life of greater than twelve (12) months, then an expiration date of at least three twelve (312) years months remaining on the date of shipping of the Product; and (b) if such a Product has a shelf life of twelve (12) months or less, then at least seventy-five percent (75%) shelf life remaining from the date of manufacture and have a least a six (6) month shelf life from the date of acceptance shipping of the Product by the Member. For Products that have an expiration dates less than six (6) months, Vendor will (A) discount the Product no less than twenty percent (20%); (B) Member must be notified and provided written consent before delivery; and (C) Products must be usable for at least fifteen (15) days on the date received by MemberProduct.

All Products supplied to Members Authorized Wholesalers, Vendor Authorized Wholesalers or directly to Member must have an expiration date of at least three (3) years from the date of manufacture and have a least a six (6) month shelf life from the delivery date of acceptance of the Product by the MemberAuthorized Wholesaler or Vendor. For Products that have an expiration dates less than six (6) months, Vendor will (A) discount the Product no less than twenty percent (20%); (B) Member must be notified and provided written consent before delivery; and (C) Products must be usable for at least fifteen (15) days on the date received by Member.

All Products supplied to Members Authorized Wholesalers must have an expiration date of at least three one (31) years year from the date of manufacture and have a least a six (6) month shelf life from the date of acceptance of the Product by the MemberAuthorized Wholesaler. For Products that have an expiration dates less than six (6) months, Vendor will (A) discount the Product no less than twenty percent (20%); (B) Member must be notified and provided written consent before delivery; and (C) Products must be usable for at least fifteen (15) days on the date received by Member.
