Common use of Product Recalls Clause in Contracts

Product Recalls. If any Product covered by this Agreement requires modification, is removed, or recalled by the Vendor, then Vendor will promptly notify MMCAP Infuse and the affected Members within three (3) days. Vendor agrees to comply with any process mandated by the FDA, or any other regulatory body if applicable, and will address the recall with each Member. Members will not incur costs for Product returns related to recalls Vendor will issue credit for recalled Product.

Product Recalls. If any Product covered by this Agreement requires modification, is removed, or recalled by the Vendor, then Vendor shall comply with its recall policy on Attachment F. Vendor will promptly notify MMCAP Infuse and the affected Members within three (3) daysbusiness days of any recall impacting Members. Vendor agrees to comply with any process mandated by the FDA, or any other regulatory body if applicable, and will address the recall with each Member. Members will not incur costs for Product returns related to recalls Vendor will issue credit for recalled Product.

If any Product covered by this Agreement requires modification, is removed, or recalled by the Vendor, then Vendor will promptly use commercially reasonable effort to notify MMCAP Infuse Infuse, Participating Members with recent direct purchases from Vendor and the affected Members Authorized Wholesalers within three five (35) days. Vendor agrees to comply with any process mandated by the FDA, or any other regulatory body if applicable, and will address the recall with each MemberParticipating Member and Authorized Wholesalers as set forth above. Participating Members and Authorized Wholesalers will not incur costs for Product returns related to recalls Vendor will issue credit for recalled Product.
