Common use of Product Trademarks & Product Designation Clause in Contracts

Product Trademarks & Product Designation. Genocea shall select and own the Product Trademarks for each Licensed Product and shall be solely responsible for filing and maintaining the Product Trademarks in the Territory. Genocea shall assume full responsibility, at its sole cost and expense, for any infringement of a Product Trademark for a Licensed Product by a Third Party (and shall retain in full any recoveries for such infringement) and shall defend and indemnify Isconova for and against any claims of infringement of the rights of a Third Party by Isconova’s use of a Product Trademark in connection with a Licensed Product in accordance with the terms of this Agreement. In addition, Genocea shall have the right to select the product designation or generic name for the Licensed Product.
