Production License. Subject to Customer’s compliance with the terms and conditions of this Agreement, and provided Tellius has accepted an Order Form for such license, Tellius hereby grants Customer a worldwide, nonexclusive, nontransferable, nonsublicensable, revocable right and license to (i) access and use the Tellius Software via a web browser or web-enabled device and (ii) use the Software solely for the purposes of accessing and using the Services. If Tellius provides a Customer with any Software under an open source license, there may be provisions in those licenses that conflict with these Terms, in which case the open source provisions will apply with respect to the code to which those provisions apply.
Production License. If a “Production License” is indicated on the Order, Customer may use the Software and Documentation solely for its own computing needs during the License Term (subject to termination of this ▇▇▇▇), and not on behalf of any other entity, under the restrictions of use indicated on the Order.
Production License. Upon payment of the applicable fees for the Software and continuous compliance with the terms and conditions of this Agreement, Syncplify hereby grants You a limited, non-exclusive, nontransferable license to use the object code of the Software and Documentation in Your facility or in the cloud, subject to the terms contained herein:
a) For each Software license key that You purchase, You may: (i) use the Software on any single Computer, unless the Documentation clearly indicates otherwise; and (ii) copy the Software for back- up and archival purposes, provided any copy must contain all of the original Software's proprietary notices and a notice that it will not be used for transfer, distribution or sale.
b) The Software is in use on a Computer when it is loaded into temporary memory or installed in permanent memory (hard drive, CD-ROM or other storage device). You agree to use Your reasonable efforts to prevent and protect the contents of the Software and Documentation from unauthorized use or disclosure, with at least the same degree of care that You use to protect Your own confidential and proprietary information, but in no event less than a reasonable degree of care under the circumstances. You agree that You will register this Software only with Syncplify and that You will only install a Software license key obtained directly from Syncplify.
Production License. Production License. The Production License is for entities using the Service for commercial purposes, and allows up to 100 Permitted Users. Under the Production License Your account will be credited with 600 Credits per month per Permitted User which may be used to download Poliigon Assets from the Service
Production License. Should the Customer require production (“Production”) license rights, then Production Software license(s) for the Software (“Docentric Server” in case of Microsoft Dynamics AX, or “Docentric AX Plug-in” in case of Microsoft Dynamics 365 for Finance and Operations) must be purchased in accordance with this Clause 3.4.

Production License. In addition to the other licenses granted by this Agreement, within the Manufacturing Field, XOMA hereby grants to Merck a non-exclusive, non-assignable and non-transferable (other than as provided in Section 9.2), right and license under the XOMA Patent Rights and the XOMA Know-How, without the right to sublicense (except as provided in Section 3.2), to:
(a) make and have made Merck Products at the Merck Authorized Sites and/or the XOMA Authorized Sites for itself and/or for Merck Affiliates or Merck Selling Entities; and
(b) to use, sell, have sold, offer to sell, import and/or export Merck Products. The license granted in this Section 3.1 shall not be effective unless and until Merck makes the payment provided for in Section 4.3 in accordance with the terms thereof. The license granted in this Section 3.1 shall not extend to any claims in any of the XOMA Patent Rights for the production of Immunoglobulins outside of bacterial hosts or bacterial cells or to any composition of matter or article of manufacture discovered, isolated, characterized, modified, made or developed by a Third Party other than a Merck Collaborator. The rights granted to Merck pursuant to this Section 3.1 shall be extended to sites managed by Merck or a Merck Affiliate in addition to the Merck Authorized Sites upon payment to XOMA of the fee set forth in the proviso to Section 4.3, whereupon the rights and obligations of Merck with respect to the license granted in this Section 3.1 shall also be extended to each such additional site and such Merck Affiliate, if applicable, mutatis mutandis.
