Common use of Products and Required Permits Clause in Contracts

Products and Required Permits. (a) Without limiting the generality of Section 7.08, in connection with the development, testing, manufacture, marketing or sale of each and any Product by the Borrower or any Subsidiary, the Borrower or such Subsidiary shall comply in all material respects with all Required Permits at all times issued by any Government Authority, specifically including the FDA, with respect to such development, testing, manufacture, marketing or sales of such Product by the Borrower or such Subsidiary.

(a) Without limiting the generality of Section 7.086.08, in connection with the development, testing, manufacture, marketing or sale of each and any Product by the Borrower or any SubsidiarySubsidiary (other than Products abandoned in the ordinary course of the Borrower’s business), the Borrower or such Subsidiary shall comply in all material respects with all Required Permits at all times issued by any Government Authority, specifically including the FDA, with respect to such development, testing, manufacture, marketing or sales of such Product by the Borrower or such Subsidiary.

(a) Without limiting the generality of Section 7.08, in connection with the development, testing, manufacture, marketing marketing, transport, distribution or sale of each and any Product by the Borrower or any Subsidiary, the Borrower or such the applicable Subsidiary shall obtain, maintain, preserve and comply in all material respects with all Required Permits at all times issued by any Government Authority, specifically including the FDA, with respect that are necessary or material to such development, testing, manufacture, marketing marketing, transport, distribution or sales of such Product by the Borrower or such Subsidiary.
