Programming of Work12. 5.1 The Parties shall co-operate as set out in this clause 5 in the planning and development of an Implementation Programme, including any enabling works and the utilisation of Possessions to facilitate both the safe and efficient execution of the Works and operation of the Net work.
5.2 Within ten (10) Working Days of a written request from the Customer, Network Rail shall inform the Customer of the anticipated timescales for booking Possessions to assist the Customer in preparation of the Implementation Programme. As soon as reasonably practicable and in any event prior to the date by which Network Rail needs to initiate the booking process for possessions as advised to the Customer, the Customer shall submit a detailed Implementation Programme for acceptance in principle by Network Rail. Such programme shall be co-ordinated with the Construction Phase Plan and shall include:
(a) submission and acceptance dates and activity duration for:
(i) Design Data;
(ii) survey works;
(iii) enabling works;
(iv) Possessions forming a proposed Possession Plan in accordance with clause 6.10;
(v) Work Package Plans;
(vi) works inspection, testing and Commissioning plans;
(b) plans to address any Interfacing Projects to the extent that Network Rail has provided sufficient information to the Customer to enable the Customer to plan around Interfacing Projects;
(c) identification of the activities dependent on possession working, including the provision of key information requirements and obtaining Necessary Consents for which the Customer is responsible;
(d) the Planned Construction Completion Date;
(e) the anticipated Taking Over Date;
(f) the anticipated Defects Identification and Completion Date; and
(g) the anticipated Final Completion Date.
5.3 Network Rail shall review the Implementation Programme and use reasonable endeavours to provide the Customer with written comments or request further information that Network Rail requires in order to comment on or accept the Implementation Programme within ten (10) Working Days13 of receipt of the Implementation Programme.
