Prohibition of Group Actions. Claims must be brought in your individual capacity, not as a representative or class member in any purported class or representative proceeding. The arbitrator shall not consolidate claims of different employees into one proceeding, nor shall the arbitrator have the power to hear arbitration as a class action. In addition to waiving your right to participate in class action arbitration, you also waive your right to bring claims pursuant to the Private Attorney General Act of 2004 (“PAGA”), codified in California Labor Code § 2698, et seq. or in a Private Attorney General capacity.
