Common use of Prohibition on Unauthorized Use or Disclosure Clause in Contracts

Prohibition on Unauthorized Use or Disclosure. The Business Associate will neither use nor disclose the Covered Entity’s Protected Health Information, except as permitted or required by this Addendum or in writing by the Covered Entity or as Required by Law. This Agreement does not authorize the Business Associate to use or disclose the Covered Entity’s Protected Health Information in a manner that will violate Subpart E of 45 CFR Part 164 if done by the Covered Entity.

This Agreement does not authorize the Business Associate to use or disclose the Covered Entity’s Protected Health Information in a manner that will would violate Subpart E the requirements of 45 CFR Part 164 HIPAA and its implementing regulations if done by the Covered Entity, except as set forth in Section 3.2.

Part 164, Subpart E “Privacy of 45 CFR Part 164 Individually Identifiable Health Information” (“Privacy Rule”) if done by the Covered EntityOrganization, except as set forth in Section 1(a) (ii) of this Addendum.

This Agreement does not authorize the Business Associate to use or disclose the Covered Entity’s Protected Health Information in a manner that will would violate Subpart E the requirements of 45 CFR Part 164 HIPAA and its implementing regulations if done by the Covered Entity, except as set forth in Section 3.2.

This Agreement does not authorize the Business Associate to use or disclose the Covered Entity’s Companies’ Protected Health Information in a manner that will would violate Subpart E of 45 CFR Part 164 the Privacy Rule or the HITECH Act if done by the Covered EntityCompanies, except as set forth in Section 1(a)(ii).
