Prohibition on Unauthorized Use or Disclosure. Business Associate will neither use nor disclose any of Covered Entity’s Protected Health Information, except as permitted or required by this Agreement or in writing by Covered Entity. This Agreement does not authorize Business Associate to use or disclose any of Covered Entity’s Protected Health Information in a manner that would violate the Privacy Rule or the Texas Privacy Law if done by Covered Entity. Covered Entity shall not request Business Associate to use or disclose any of Covered Entity’s Protected Health Information in any manner that would not be permissible under the Privacy Rule or the Texas Privacy Law if done by Covered Entity.
