Project Operation.
A. Plan Implementation and Adherence The Certificate Holder shall adhere to and implement the provisions of the required plans, submittals, permits, the Revised MDNS, the ASC, and any relevant regulation during project operation.
Project Operation. 11.4.1. Operator shall operate and maintain the Project Facility during the Agreement Period and adhere to Operation and Maintenance Requirements as mentioned in Schedule G. If DTTDC / PMB finds Operator failing to meet any Operation and Maintenance Requirements as stated in Schedule G, then DTTDC / PMB shall give a notice to Operator stating the fault (the “Fault”) and grant 5 (five) days to rectify the same. If DTTDC/ PMB finds the Fault has not been rectified within the time period specified, then DTTDC shall have the right to rectify the Fault and recover the expenses for the same from Operator. In such case, DTTDC shall have the right to encash Performance Security to the extent of expenses incurred in rectification of the fault.
11.4.2. Operator shall be required to apply for and obtain clearances as applicable for holding any event in the Project Facility, including but not limited to permissions from local bodies, police, traffic, fire etc.
11.4.3. Repair and maintenance of any kind in the Project Facility shall be the responsibility of Operator. However, Operator shall be required to take prior approval of DTTDC before undertaking any major maintenance in the Project Facility, including but not limited to painting and whitewashing.
11.4.4. Operator shall maintain the items mentioned under Schedule H in operational state. Any repair, maintenance and replacement of items will be the responsibility of Operator. Operator shall have to take prior approval of DTTDC before making any replacements of items stated in Schedule H to this Agreement.
11.4.5. Operator shall keep the premises clean and shall ensure proper disposal of any garbage generated in the Project Facility.
11.4.6. Operator shall ensure that operation of Project Facility does not disturb operations of other activities in Dilli Haat Janakpuri.
11.4.7. Operator shall not damage the existing structures of Project Facility and of Dilli Haat Janakpuri. Operator shall have to take written approval from DTTDC before carrying out temporary or permanent construction activity in the Project Facility. It shall be the responsibility of Operator that the greenery of Dilli Haat Janakpuri is not destroyed due to any activities carried out in Project Facility.
11.4.8. The Operator recognises and acknowledges the fact that the Project is intended to provide a public facility and the Operator shall have no right to prevent, impede or obstruct any bona fide Users from using the Project Facility, save for reg...
Project Operation. The Sponsored Organization agrees to implement and operate the Project in accordance with the terms of this agreement and with any requirements imposed by funding organizations.
Project Operation.
A. Technical Advisory Committee (TAC) The purpose of the Technical Advisory Committee (TAC) is to advise EFSEC on the effectiveness of mitigation measures as they have been implemented. TAC will also make recommendations to EFSEC if it deems additional studies or mitigation are warranted to address impacts that were either not foreseen in the Revised Application, or significantly exceed impacts that were projected. In order to make advisory recommendations to EFSEC, the TAC will review and consider results of the Project monitoring studies. The TAC will assess whether the post- construction restoration and mitigation and monitoring programs merit further studies or additional mitigation, taking into consideration factors such as the species involved, the nature of the impact, monitoring trends, and new scientific findings. The TAC may include, but need not be limited to, representatives from WDFW, U.S. Fish and Wildlife Service, Ecology, EFSEC, Kittitas County and the Certificate Holder. EFSEC, at its discretion, may add additional representatives to the TAC from state, local, federal and tribal governments. All TAC members must be approved by EFSEC. No later than sixty (60) days prior to the beginning of Site Preparation, the Certificate Holder shall contact the agencies and organizations listed above requesting that they designate a representative to the TAC, and that the agencies or organizations notify EFSEC in writing of their TAC representative and of their member’s term of representation. No later than sixty (60) days prior to the beginning of Commercial Operation, the Certificate Holder shall convene the first meeting of the TAC. The TAC will be convened as determined by EFSEC, except that EFSEC may terminate the TAC if: the TAC has ceased to meet due to member attrition; or, the TAC determines that all of the pre-permitting, operational and post-operational monitoring has been completed and further monitoring is not necessary; or the TAC members recommend that it be terminated; or, upon request by Certificate Holder, after the first year of operation of the Project. The ultimate authority to require implementation of additional mitigation measures, including any recommended by the TAC, shall reside with EFSEC.

Project Operation there has been no material change in the conduct or operation of the Project from that contemplated in the Cashflow Model and Project Plan;
Project Operation. The proposed project would involve the storage, handling, and use of hazardous materials. The project will conform to all federal, state and local regulations regarding the transportation, use, storage, generation and disposal of hazardous materials to minimize potential health and environmental hazards that could occur through accidental spills or leakage. A Business Emergency Plan (BEP) and Hazardous Materials Inventory will be prepared by the project for submittal to the City of Huntington Beach Certified Unified Program Agency. In addition to identifying hazardous substances, the BEP includes details that facilitate coordination and emergency planning with on- and off-site response officials and facilities in the event of an emergency. RO Membrane Cleaning Solution. The citric acid, sodium hydroxide, sodium tripolyphosphate, and sodium dodecylbenzene would be delivered to the subject site in 50-gallon plastic containers and would be stored in the RO building within concrete enclosures for use of cleaning of RO membranes. A drainage system would be provided for chemical evacuation in the event of an accidental spill. As these chemicals would not be used frequently, they would be delivered to the site on an as-needed basis, and no more than one container per chemical would typically be stored or used at one time. The chemicals listed in the SEIR are nonflammable and would be stored and used at the treatment facility site in quantities below the threshold quantity levels, as defined by the applicable federal, state, and local hazardous materials handling and management regulations, at which they would present a potential for a significant hazard to the public or the environment.
Project Operation. To guarantee the normal operation of this project, both sides form a project management group. This group should be in line with the principle that guarantees the teaching quality and brand making. The organization manages the daily operation of this project and regularly reports the project progress to all parts.

Project Operation. The Company will:
(a) operate, maintain and preserve the Vessel and all of its other Properties necessary or useful in the proper conduct of its business in good working order and in such condition that the Vessel will have the capacity and functional ability to (i) perform, on a continuing basis (ordinary wear and tear excepted), in normal commercial operation, the functions for which it was specifically designed in accordance with the Project Documents at substantially the levels contemplated thereby and (ii) maintain the classification contemplated by Section 4.17 or with such other classification society that is reasonably acceptable to the Collateral Agent, acting upon the recommendation of the Independent Engineer;
(b) maintain all permits and certificates required for the operation of the Vessel;
(c) cause the Manager to undertake to operate, service, maintain and repair the Vessel so that the condition and operating efficiency thereof will be maintained and preserved (ordinary wear and tear excepted) in all material respects in accordance and compliance with (i) Good Utility Practices, (ii) such operating standards as shall be required to enforce any material warranty claims against dealers, manufacturers, vendors, contractors, and sub-contractors, (iii) the terms and conditions of all insurance policies maintained with respect to the Vessel at any time and (iv) the terms and conditions of the Project Documents;
(d) take such steps as are reasonably practicable to ensure that the Vessel and its constituent parts will be safe and without risk to health, safety or the environment when properly used;
(e) cause the management of the Vessel to be carried out at all times by (i) the Manager, (ii) an Affiliate of Teekay or (iii) a ship management company or companies of international standing and experienced in the operation of LNG vessels, such company or companies to be acceptable to Charterer and approved by the Collateral Agent, such approval not to be unreasonably withheld or delayed;
(f) promptly pay any tolls, dues, premia, fees and other outgoings whatsoever in respect of the Vessel and the insurance policies required by it to be maintained hereunder; and
(g) promptly deliver to the Collateral Agent any notices of default under the Charter.
Project Operation. There has been no material change in the conduct or operation of the Marigold Project from that contemplated in the applicable Life of Mine Plan. No Person has any right, title or interest in Marigold Project Assets other than Marigold Mining Company.
