Projected Delivery Date; Delivery Date; Commencement Date: Tenant’s Obligations During Construction Period; Term. (a) Landlord shall tender to Tenant possession of the Premises no later than the date which is one (1) days after the execution of this Lease by Landlord and Tenant (the “Projected Delivery Date”). On the date Landlord actually tenders to Tenant possession of the Premises (the “Delivery Date”), the Premises shall be subject to, and Tenant shall observe and perform, all the conditions and covenants applicable to Tenant under this Lease, except as otherwise expressly provided in this Rider. During the period (the “Construction Period”) from the Delivery Date until the Commencement Date (defined below), in recognition of Tenant’s construction and installations in, and preparation of, the Premises for the use and occupancy permitted by this Lease, Tenant shall not be obligated to pay Monthly Base Rent, Rent Adjustment Deposits or Rent Adjustments. The Term of this Lease shall be as shown in Section 1.01(5) of the Basic Lease Provisions and the Commencement Date of the Term shall be the date which is the earlier to occur of (i) the date Tenant commences its business operations in the Premises, or (ii) two hundred (200) days after the Delivery Date. (b) Within thirty (30) days following the occurrence of the Commencement Date, upon request by Landlord, Tenant and Landlord shall enter into an agreement (which is attached to this Lease as Rider 1) confirming the Commencement Date and the Expiration Date. If Tenant fails to enter into such agreement, then the Commencement Date and the Expiration Date shall be the dates designated by Landlord in such agreement.

(a) Landlord shall tender to Tenant possession of the Premises in the condition required by Section 1 of the Workletter no later than the date which is one five (15) days after the later of the full execution and delivery of this Lease by Landlord and Tenant Landlord’s recovery of possession of the Premises from the prior tenant and the termination of such tenant’s lease (the “Projected Delivery Date”), which Projected Delivery Date is estimated to occur on August 15, 2017. On the later of the date Landlord actually tenders to Tenant possession of the Premises in the condition required by Section 1 of the Workletter with the prior tenant’s lease terminated and the full execution and delivery of this Lease (the “Delivery Date”), all the Premises terms and conditions of the Lease shall be subject toapply, and Tenant shall observe and perform, perform all terms and conditions of the conditions and covenants applicable to Tenant under this Lease, including all that are specified to apply during the Term (for example only, Tenant’s insurance and indemnification obligations), except as otherwise expressly provided in this Rider. During that during the period (the “Construction Period”) from the Delivery Date until the Commencement Date (defined below)Date, in recognition of Tenant’s construction and installations in, and preparation of, the Premises for the use and occupancy permitted by this Lease, Tenant shall not be obligated to pay Monthly Base Rent, Rent Adjustment Deposits or Rent Adjustments. The Term of this Lease shall be as shown in Section 1.01(5) of the Basic Lease Provisions and the Commencement Date of the Term shall be the date which is the earlier to occur of sixty (i) the date Tenant commences its business operations in the Premises, or (ii) two hundred (20060) days after the Delivery Date. (b) Within thirty (30) days following the occurrence of the Commencement Date, upon request by Landlord, Tenant and Landlord shall enter into an agreement (which is attached to this Lease as Rider 1) confirming the Commencement Date and the Expiration Date. If Tenant fails to enter into such agreement within ten (10) business days after Landlord’s request enclosing the proposed agreement, then the Commencement Date and the Expiration Date shall be the dates designated by Landlord in such agreement.

On the date Landlord actually tenders to Tenant possession of the Premises (the “Delivery Date”), all the Premises terms and conditions of the Leases shall be subject toapply, and Tenant shall observe and perform, perform all the conditions such terms and covenants applicable to Tenant under this Leaseconditions, except as otherwise expressly provided in this Rider. During the period (the “Construction Period”) from the Delivery Date until the Commencement Date (defined below), in recognition of Tenant’s construction and installations in, and preparation of, the Premises for the use and occupancy permitted by this Lease, : (i) Tenant shall not be obligated to pay Monthly Base Rent, Rent Adjustment Deposits or Rent Adjustments; and (ii) Landlord shall not be obligated to provide services or utilities except if and to the extent expressly provided in Section 4 of the Workletter. The Term of this Lease shall be as shown in Section 1.01(5) of the Basic Lease Provisions and the “Commencement Date Date” of the Term shall be the date which is the earlier to occur of four (i4) the date Tenant commences its business operations in the Premises, or (ii) two hundred (200) days months after the Delivery Date. (b) Within thirty (30) days following the occurrence of the Commencement Date, upon request by Landlord, Tenant and Landlord shall enter into an agreement (which is attached to this Lease as Rider 1) confirming the Commencement Date and the Expiration Date. If Tenant fails to enter into respond to such agreementagreement within ten (10) business days following Landlord’s request, then the Commencement Date and the Expiration Date shall be the dates designated by Landlord in such agreement.

On the date Landlord actually tenders to Tenant possession of the Premises with any Landlord Work Substantially Complete (the “Delivery Date”), all the Premises terms and conditions of the Lease shall be subject toapply, and Tenant shall observe and perform, perform all terms and conditions of the conditions and covenants applicable to Tenant under this Lease, including all that are specified to apply during the Term (for example only, Tenant’s insurance and indemnification obligations), except as otherwise expressly provided in this Rider. During that during the period (the “Construction Period”) from the Delivery Date until the Commencement Date (defined below), in recognition of Tenant’s construction and installations in, and preparation of, the Premises for the use and occupancy permitted by this Lease, : (i) Tenant shall not be obligated to pay Monthly Base Rent, Rent Adjustment Deposits or Rent Adjustments; and (ii) Landlord shall not be obligated to provide services or utilities except if and to the extent expressly provided in Section 4 of the Work Letter. The Term of this Lease shall be as shown in Section 1.01(5) of the Basic Lease Provisions and the Commencement Date of the Term shall be the date which is the earlier later to occur of of: (i) the date Tenant commences its business operations in the PremisesJuly 1, 2014; or (ii) two one hundred fifty (200150) days after the Delivery Date. (b) Within thirty (30) days following the occurrence of the Commencement Date, upon Upon request by Landlord, Tenant and Landlord shall enter into an agreement (the form of which is attached to this Lease as Rider 1) confirming the Commencement Date and the Expiration Date. If Tenant fails to enter into such agreement within ten (10) business days after Landlord’s request enclosing the proposed agreement, then the Commencement Date and the Expiration Date shall be the dates designated by Landlord in such agreement.

During that during the period (the “Construction Period”) from the Delivery Date until the Commencement Date (defined below), in recognition of Tenant’s construction and installations in, and preparation of, the Premises for the use and occupancy permitted by this Lease, : (i) Tenant shall not be obligated to pay Monthly Base Rent, Rent Adjustment Deposits or Rent Adjustments; and (ii) Landlord shall not be obligated to provide services or utilities except if and to the extent expressly provided in Section 4 of the Workletter. The Term of this Lease shall be as shown in Section 1.01(5) of the Basic Lease Provisions and shall commence on the date specified in Section 1.01(6) of the Basic Lease Provisions as the Commencement Date of the Term shall be the date which is the earlier to occur of (i) the date Tenant commences its business operations in the Premises, or (ii) two hundred (200) days after the Delivery Date. (b) Within thirty (30) days following the occurrence of the Commencement Date, upon Upon request by Landlord, Tenant and Landlord shall enter into an agreement (the form of which is attached to this Lease as Rider 1) confirming the Commencement Date and the Expiration Date. If Tenant fails to enter into such agreement within five (5) business days after Landlord’s request enclosing the proposed agreement, then the Commencement Date and the Expiration Date shall be the dates designated by Landlord in such agreement.
