Common use of Prolonged Outages Clause in Contracts

Prolonged Outages. Seller shall notify Buyer of a Prolonged Outage as soon as practicable under the circumstances by submitting a completed Outage Notification Form in accordance with the provisions set forth in Appendix IX, and provide an estimate of the duration of the outage therein. Seller shall notify Buyer in writing when the Project is again capable of meeting its Contract Quantity on a pro rata basis. Seller shall not substitute Energy from any other source for the output of the Project during a Prolonged Outage.

Prolonged Outages. Seller shall notify Buyer of a Prolonged Outage as soon as practicable under the circumstances by submitting a completed Outage Notification Form in accordance with the provisions set forth in Appendix IX, and provide an estimate of the duration of the outage therein. Seller shall notify Buyer in writing when the Project is again capable of meeting its Contract Quantity nameplate capacity on a pro rata basis, in accordance with the provisions in Appendix A, section B(2)(f). Seller shall not substitute Energy from any other source for the output of the Project during a Prolonged Outage.

Seller shall provide an estimate periodic estimates to Buyer of the remaining duration of the outage therein. Seller shall notify Buyer in writing when the Project is again capable of meeting its Contract Quantity on a pro rata basisoutage. Seller shall not substitute Energy power from any other source for the output of the Project during a Prolonged Outage.

During the Delivery Term, Seller shall notify Buyer of a Prolonged Outage as soon as practicable under the circumstances by submitting a completed Outage Notification Form in accordance with the provisions Actual Availability Report as set forth in Appendix IXXI, and provide an estimate of the duration of the outage therein. Seller shall notify Buyer in writing when the Project is again capable of meeting its Contract Quantity on a pro rata basis. Seller shall not substitute Energy from any other source for the output of the Project during a Prolonged Outage.

Seller shall not substitute Energy from any other source for the output of the Project during a Prolonged Outage.
