Property Status of Gaming Devices; Taxes. (a) The Gaming Devices and Incidental Equipment shall, for all purposes, be and remain MGI's personal property and shall not become real property. MGI will pay any sales, use, excise, privilege or personal property taxes (or other taxes) or fees levied against any Gaming Devices and/or any item of Incidental Equipment, based on the installations and/or operation of the Gaming Devices, or any of them, and/or the Incidental Equipment, or based upon the business activities of MGI.
