Providing Updated Surveys. Upon completion of the foundation, and at such other times as Agent may deem appropriate in good faith, Borrower shall furnish to Agent six (6) copies of a certified survey of the Property, certifying that the Improvements are constructed within the property lines of the Land, do not encroach upon any easement affecting the Land (other than such encroachments which have been insured over to Agent’s satisfaction or which have been approved as permissible by the other parties to such easement) and do comply with all applicable Governmental Requirements relating to the location of improvements, along with a letter from the Title Company confirming the acceptability of said survey.
Providing Updated Surveys. Upon completion of the Improvements, and at such other times as Lender may deem appropriate, the Borrower shall furnish to the Lender a certified survey of the Project, evidencing that the Improvements are constructed within the property lines of the Land, do not encroach upon any easement affecting the Land and do comply with all applicable Governmental Requirements relating to the location of Improvements, along with a letter from the Title Company or an endorsement to the Title Policy, at the Lender’s option, confirming the acceptability of said survey.
Providing Updated Surveys. At such times as the Required Lenders for a Series Loan or the Administrative Bank may deem appropriate, Borrower shall furnish to each of the Primary Lenders for such Series Loan, the Administrative Bank and the Collateral Agent three (3) copies of a certified survey of the Project being financed by such Series Loan, certifying that the Improvements for such Project are constructed within the property lines of such Project's Land, do not encroach upon any easement affecting such Land and do comply with all applicable Governmental Requirements relating to the location of such Improvements, along with a letter from the Title Company for such Series Loan confirming the acceptability of said survey.
Providing Updated Surveys. If required by Administrative Agent, upon request of Administrative Agent, upon an Event of Default, Borrowers must deliver to Administrative Agent, at Borrowers' cost and expense, 1 copy of a Survey for each Project, certifying that the Improvements are constructed within the property lines of the Land, do not encroach upon any easement affecting the Land and do comply with all applicable Governmental Requirements relating to the location of Improvements, along with an endorsement to the Title Policy bringing forth the effective date thereof to the date of said Survey without exception therefor, if applicable.

Providing Updated Surveys. Upon completion of the foundation of the Improvements, Borrower shall cause the Title Company to issue an endorsement to the Title Policy in form and substance acceptable to Bondowner Representative insuring that all foundations and footings are within the boundaries of the Property and that no buildings are to be constructed within the areas of any easement.‌
Providing Updated Surveys. Upon request of Bank, upon completion of the foundations of the Improvements and at such other times as Bank may reasonably deem appropriate, Borrower shall furnish to Bank, at Borrower’s cost and expense, three (3) copies of a certified foundation survey of the Project prepared in accordance with Bank’s standard requirements, certifying that the Improvements are constructed within the property lines of the Land, do not encroach upon any easement affecting the Land and do comply with all applicable Governmental Requirements relating to the location of Improvements, together with an endorsement to the Title Policy bringing forth the effective date thereof to the date of said survey without exception therefor.
