Common use of Provision and operation of the Terminal Clause in Contracts

Provision and operation of the Terminal. In granting to the User the Access referred to in clause 3.1, DBCT Management must, subject to this Agreement: (a) make the Terminal available and operate it to enable the Annual Contract Tonnage (subject to delivery to the Terminal and the availability of vessels) to be Handled at the Terminal in each Financial Year; and (b) provide Services as required by the User.
