Provision Applicable to a Recipient Other Than a Private Entity. FTA may unilaterally terminate the Grant Agreement or Cooperative Agreement for the Project, without penalty to the Federal Government, if a subrecipient that is a private entity-- (a) Is determined to have violated an applicable prohibition in Subparagraph 3.g(3)(a) of this Master Agreement; or (b) Has an employee whose conduct is determined by an FTA official authorized to terminate the Grant Agreement or Cooperative Agreement for the Project to have violated an applicable prohibition in Subparagraph 3.g(3)(a) of this Master Agreement because that employee’s conduct is either--
