Common use of PROVISIONAL REMEDIES, SELF HELP AND FORECLOSURE Clause in Contracts

PROVISIONAL REMEDIES, SELF HELP AND FORECLOSURE. No provision of this Agreement shall limit the right of any party to (i) exercise self-help remedies including, without limitation, set-off, (ii) foreclose against or sell any collateral, by power of sale or otherwise or (iii) obtain or oppose provisional or ancillary remedies from a court of competent jurisdiction before, after or during the pendency of the Reference. The exercise of, or opposition to, any such remedy does not waive the right of any party to a Reference pursuant to this Agreement.

PROVISIONAL REMEDIES, SELF HELP AND FORECLOSURE. No provision of this Agreement section shall limit the right of any party to (i) this Agreement to exercise self-help remedies includingsuch as setoff, without limitation, set-off, (ii) to foreclose against or sell any collateral, by power of sale real or otherwise personal property collateral or (iii) security or to obtain or oppose provisional or ancillary remedies from a court of competent jurisdiction before, after after, or during the pendency of the Referenceany arbitration or other proceeding. The exercise of, or opposition to, any such of a remedy does not waive the right of any either party to a Reference pursuant resort to this Agreementarbitration or reference.
