Common use of Public Dock Clause in Contracts

Public Dock. Notwithstanding the laytime and demurrage provisions set forth above in this Agreement, the Parties hereto agree and acknowledge that, if delivery pursuant to this Agreement is made at a public terminal, where the terminal meets the criteria listed on the Leadership for Energy Automated Processing (‘LEAP’) website under public dock criteria at xxxx://xxx.xxxxxxxxxx.xxx/publicdockclause/ and if at a terminal which is on the “Public Dock List” as available on the LEAP website at xxxx://xxx.xxxxxxxxxx.xxx/publicdockclause/public-dock-list/ in cases in which delays are directly attributable to berth congestion, and demurrage would otherwise be payable, laytime shall not be considered to commence until Vessel is All Fast at the dock.
