PUBLIC INTEREST COMMITMENTS. 1. Within 30 days following the first Registry Level Transaction Fee Adjustment Approval Date, Registry Operator agrees to perform the following specific public interest commitments, which commitments shall be enforceable by ICANN and through the Public Interest Commitment Dispute Resolution Process established by ICANN (posted at xxxx://xxx.xxxxx.xxx/en/resources/registries/picdrp), which may be revised in immaterial respects by ICANN from time to time (the “PICDRP”). Registry Operator shall comply with the PICDRP. Registry Operator agrees to implement and adhere to any remedies ICANN imposes (which may include any reasonable remedy, including for the avoidance of doubt, the termination of the Registry Agreement pursuant to Section 6.1(a) of the Agreement) following a determination by any PICDRP panel and to be bound by any such determination.

Registrar must also provide Registrant with a description of potential consequences for such activities, including suspension of the domain name.

Registry Operator will operate the registry for the TLD in compliance with all commitments, statements of intent and business plans stated in the following sections of Registry Operator’s application to ICANN for the TLD, which commitments, statements of intent and business plans are hereby incorporated by reference into this Agreement. Registry Operator’s obligations pursuant to this paragraph shall be enforceable by ICANN and through the PICDRP (as defined in Section 3 below). Registry Operator shall comply with the PICDRP. Registry Operator agrees to implement and adhere to any remedies ICANN imposes (which may include any reasonable remedy, including for the avoidance of doubt, the termination of the Registry Agreement pursuant to Section 4.3(e) of the Registry Agreement) following a determination by any PICDRP panel and to be bound by any such determination. The above paragraph in this Section 2 of this Specification applies to the following sections of Registry Operator’s new gTLD application for the TLD (Application ID: 1-912-59314). Application Sections 18 (Mission/Purpose) & 20 (Community-based Designation). Nothing in this Section 2 of this Specification (including the referenced application sections) shall limit any obligations of Registry Operator under Sections 1 and 3 of this Specification. In the event of any conflict between this Section 2 of this Specification (including the referenced application sections) with any other provision of the Registry Agreement (including any other Section of this Specification), such other provision shall govern and will supersede this Section 2 to the extent of the conflict. PUBLIC INTEREST COMMITMENTS. The Registrar shall also include in its Registration Agreement a specific provision prohibiting Registrants from:  distributing malware,  abusively operating botnets,  phishing,  piracy,  trademark or copyright infringement,  fraudulent or deceptive practices,  counterfeiting, or otherwise engaging in any activity contrary to any applicable law. The Registrar shall also inform the Registrant of the risks involved in these kinds of practices, including the fact that the Registry reserves the right to suspend the domain name in such a case.

If this Settlement Agreement is accepted by the Hearing Panel, Staff will not initiate any proceeding under the By-laws of the MFDA against the Respondent in respect of the facts set out in Part IV and the contraventions described in Part V of this Settlement Agreement, subject to the provisions of Part IX below.
