Common use of PUBLIC RECORD REQUIREMENTS Clause in Contracts

PUBLIC RECORD REQUIREMENTS. Bidder acknowledges that the City is a public agency and must comply with all Public Records laws and bids submitted become the property of the City and are subject to public disclosure requirements in accordance with Arizona Public Records Law. Any portion of the bid that the bidder deems confidential or proprietary must be clearly labeled as such. Labeling material does not automatically preclude the material from public disclosure, as the City is required to make an appropriate determination as to the confidentiality of the material in accordance with Arizona Public Records Law. It is the bidder’s sole responsibility and cost to take action, including legal actions, to protect such material. Price is not confidential and will not be withheld.
