Common use of Publication and Listing of Clinical Trials Clause in Contracts

Publication and Listing of Clinical Trials. Each Party agrees to comply, with respect to the listing of Clinical Trials or the publication of Clinical Trial results with respect to Licensed Products and to the extent applicable to its activities conducted under this Agreement, with (a) the Pharmaceutical Research and Manufacturers of America (PhRMA) Guidelines on the listing of Clinical Trials and the Publication of Clinical Trial results, and (b) any Applicable Law or applicable court order, stipulations, consent agreements and settlements entered into by such Party; provided that any listings or publications made pursuant to this Section 11.3 shall be considered a Publication hereunder and shall be subject to Section 11.1.

Publication and Listing of Clinical Trials. Each Party agrees to comply, with With respect to the listing of Clinical Trials or the publication of Clinical Trial results with respect to for the Licensed Products and to the extent applicable to its a Party’s activities conducted under this Agreement, each Party shall comply with (a) the Pharmaceutical Research and Manufacturers of America (PhRMA) Guidelines on the listing of Clinical Trials and the Publication of Clinical Trial results, and (b) any Applicable Law or applicable court order, stipulations, consent agreements agreements, and settlements entered into by such Party; provided . The Parties agree that any such listings or publications made pursuant to this Section 11.3 shall be considered a Publication hereunder publication for purposes of this Agreement and shall be subject to Section 11.111.2.
