Publicity; Non-disparagement. (a) In the event that any person requests information regarding the Executive’s employment with the Company and its Affiliates, the Company shall respond simply by confirming Executive’s dates of employment, job titles and rates of pay.

(a) In the event that any person requests information regarding the Executive’s employment with the Company and its Affiliates, the Company shall respond simply by confirming Executive’s dates of employment, job titles and rates of pay, and the Company’s Chief Executive Officer and Vice President of Human Resources shall respond to all such requests by potential employers consistent with the information provided in a separately agreed reference summary.

Notwithstanding the foregoing, Xxxxxxx X. Xxxxxxx, III, the Company’s Chairman and Chief Executive Officer, will also provide a reference based on the mutual agreement of Xx. Xxxxxxx and the Executive.
